General Provisions
1.1. This offer is an official proposal from Magic Rodis (hereinafter referred to as the "Seller") to conclude a distance sales agreement for goods via the online store (hereinafter referred to as the "Agreement") and is published on the Seller’s official website.
1.2. The full and unconditional acceptance of this offer by the Buyer is confirmed by the payment of the order under the terms of this Agreement.
Definitions
2.1. In this offer, unless otherwise stated by the context:
- "Goods" — models, accessories, components, and accompanying items;
- "Online Store" — a platform for presenting or selling goods through electronic transactions;
- "Seller" — the company offering goods through the website;
- "Buyer" — an individual who concludes an agreement with the Seller;
- "Order" — the selection and payment of goods by the Buyer.
Subject of the Agreement
3.1. The Seller undertakes to transfer the Goods to the Buyer, who in turn agrees to pay for and accept them.
This Agreement governs:
- selection of goods in the Online Store;
- placing an order;
- payment for the order;
- delivery of the goods to the Buyer.
Order Placement Procedure
- 4.1. The Buyer may order any goods available in the store’s catalog;
- 4.2. Any quantity of each item can be added to the order;
- 4.3. If an item is unavailable, the store manager will inform the Buyer via phone or email;
- 4.4. The Buyer may replace the product, cancel that item, or cancel the entire order.
Order Payment Procedure
Cash on Delivery
- 5.1. Payment is made in cash in UAH upon receipt of the goods at the delivery service branch;
- 5.2. If payment is not received, the Seller reserves the right to cancel the order.
Order Delivery Conditions
- 6.1. Delivery is made to the selected logistics company branch;
- 6.2. The Buyer will receive documents in accordance with Ukrainian legislation.
Rights and Obligations of the Parties
The Seller has the right to:
- 7.1. Suspend services if the Buyer violates the terms of the Agreement.
The Buyer is obliged to:
- 7.2. Pay for and collect the order on time.
The Buyer has the right to:
- 7.3. Place an order and conclude the agreement online;
- 7.4. Require the Seller to fulfill the terms of this Agreement.
Liability of the Parties
- 8.1. Both parties are liable for non-fulfillment of the Agreement;
- 8.2. The Seller is not liable for:
- product appearance changed by the manufacturer;
- slight differences in color due to monitor settings;
- incorrect information provided by the Buyer;
- delays beyond the Seller’s control;
- illegal actions of the Buyer on the Internet.
- 8.3. The Buyer is responsible for all actions performed using their credentials;
- 8.4. Force majeure events release both parties from obligations;
- 8.5. Any disputes are resolved through negotiations.
Other Terms
- 9.1. The Seller may amend the Agreement with prior publication on the website;
- 9.2. The Online Store operates as a distance-selling platform;
- 9.3. The Buyer is responsible for the accuracy of the provided information and agrees to the processing of personal data;
- 9.4. Payment confirms acceptance of the Agreement’s terms;
- 9.5. The date of the Agreement is the date of acceptance according to the Law of Ukraine "On E-Commerce";
- 9.6. Viewing products and placing orders is free of charge;
- 9.7. Buyer information is used only to fulfill the order;
- 9.7.1. Site visitors agree to the privacy policy by using the site;
- 9.7.2. Data is processed in accordance with Ukrainian law;
- 9.7.3. Data is used only for order processing and communication;
- 9.7.4. Newsletters are sent only with consent;
- 9.7.5. Personal data is not used for profiling.
Buyer’s Rights:
- 9.8.1. Change personal data if incorrect or incomplete;
- 9.8.2. Request deletion of personal data;
- 9.8.3. File a complaint via email: [email protected]
Return Policy for Quality Goods
- 10.1. Returns are processed according to the legislation of Ukraine;
- 10.2. Return shipping is paid by the Buyer;
- 10.3. Refunds are issued minus the delivery costs.
Term of the Agreement
- 11.1. The Agreement is considered concluded from the moment of acceptance;
- 11.2. The Agreement may be terminated by mutual agreement before delivery;
- 11.3. Either party may terminate the Agreement unilaterally in case of a breach.
